The following Terms of Service (“TOS”) constitutes an agreement between Porter Designs (dba of Porter Designs, Inc.) and you, the visitor, governing your access and use of any content and functionalities available at the Porter Designs website (the “Site”).

Before you may use the Site, you must read and accept all of the terms and conditions in, and linked to, this TOS. By visiting the Site, you agree to this Terms of Service. If you do not agree with everything in this document, please do not use the Site.

Porter Designs reserves the right, at its sole discretion, to change any portions of these Terms of Use at any time. It is your responsibility to check this TOS periodically for changes. Your continued use of the Site will mean that you accept and agree to the changes. As long as you comply with these, Porter Designs grants you a non-exclusive, non-transferable, limited privilege to enter and use the Site.

Use of the Site

You may not attempt to gain unauthorized access to any portion or feature of the Site. You cannot supply false information about your identity and you may not act as a representative of another person or entity. Use of the Site in any manner that may be construed as unlawful or prohibited by these Terms of Use is strictly prohibited. Indemnification: You agree to defend, indemnify and hold Porter Designs harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Site.

 

Security and Privacy Policy

Porter Design’s Privacy Policy applies to use of the Site. We consider your privacy of great importance. Porter Designs uses commercially accepted security measures to help protect your information. With this stated, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

Accounts and Passwords

You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. You agree to notify Porter Designs immediately of any unauthorized use of your account or password, or any other breach of security. However, you may be held liable for losses incurred by Porter Designs or any other user of or visitor to the Site due to someone else using your Porter Designs ID, password or account. You may not use anyone else’s Porter Designs ID, password or account at any time without the express permission and consent of the holder of that Porter Designs ID, password or account. Porter Designs cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, videos, artwork and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on the Site is owned, controlled or licensed by or to Porter Designs, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws. No part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way to any other computer, server, Web Site or other medium for publication or distribution or for any commercial enterprise, without Porter Design’s express prior written consent. Information and data made purposely available by Porter Designs such as specification sheets and product information may be downloaded from the Site provided that you follow these five rules:

 

1. Information will be used for the sole purpose of the individual’s decision on whether to purchase a particular item.
2. Proprietary language must remain on downloaded item.
3. Make no modifications to any such information.
4. Use such information only for your personal requirements only.
5. Do not make any additional representations or warranties relating to such documents.

 

Purchases; Other Terms and Conditions

Additional terms and conditions may apply to purchases of goods or services and to specific portions or features of the Site. All such terms are made a part of these Terms of Use by this reference. Errors and Inaccuracies

Porter Designs reserves the right to correct any errors, inaccuracies or omissions and to change and update information at any time without prior notice. This includes incorrect pricing and typographical errors in product descriptions and availability. Porter Designs maintains the right to correct such errors whenever found, including after an order has been submitted. Comments and Submissions

Porter Designs is and shall be under no obligation to maintain any Comments in confidence; to pay to user any compensation for any Comments; or to respond to any user Comments. You agree that no Comments submitted by you to the Site will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary rights(s). Product Representations

Porter Designs has done our best to portray our products in the most accurate way, but we cannot and will not be responsible for the way in which the photographs and product representations appear on your computer screen. There are too many variables such as color; brightness and tinting that can change how the images appear on your computer or printer.

Porter Designs does not promise that the Site or any Content, service or feature of the Site will be error free or uninterrupted, or that any defects will be corrected, or that your use of the Site will provide specific results. The Site and its Content are delivered on an as is and as available basis. All information provided on the Site is subject to change without notice. Violation of These Terms of Use

Porter Designs may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Porter Design’s rights or property, or the rights or property of visitors to or users of the Site, including Porter Design’s customers. Porter Designs reserves the right at all times to disclose any information that Porter Designs deems necessary to comply with any applicable law, regulation, legal process or governmental request. Porter Designs also may disclose your information when Porter Designs determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.

You acknowledge and agree that Porter Designs may preserve any transmittal or communication by you with Porter Designs through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or Porter Designs determines that such preservation or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that any such data violates the rights of others, or (4) protect the rights, property or personal safety of Porter Designs, its employees, users of or visitors to the Site, and the public.

You agree that Porter Designs may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to Porter Designs, for which monetary damages would be inadequate, and you consent to Porter Designs obtaining any injunctive or equitable relief that Porter Designs deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Porter Designs may have at law or in equity.

You agree that Porter Designs may, in its sole and discretion without prior notice, terminate your access to the Site, for cause, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by you (self-initiated account deletions), (3) discontinuance or material modification of the Site or any service offered on or through the Site, or (4) unexpected technical issues or problems.

If Porter Designs does take any legal action against you as a result of your violation of these Terms of Use, Porter Designs will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to Porter Designs. You agree that Porter Designs will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.

Governing Law; Dispute Resolution

You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of Oregon without regard to its conflicts of law provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Portland, OR, and waive any objection to such jurisdiction or venue. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees. In the event of any controversy or dispute between Porter Designs and you arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

If any of the provisions of these Terms of Use are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary and replaced with a valid provision that best embodies the intent of these Terms of Use, so that these Terms of Use shall remain in full force and effect. These Terms of Use constitute the entire agreement between you and Porter Designs with regard to your use of the Site, and any and all other written or oral agreements or understandings previously existing between you and Porter Designs with respect to such use are hereby superseded and cancelled. Porter Designs will not accept any counter-offers to these Terms of Use, and all such offers are hereby categorically rejected. Porter Design’s failure to insist on or enforce strict performance of these Terms of Use shall not be construed as a waiver by Porter Designs of any provision or any right it has to enforce these Terms of Use, nor shall any course of conduct between Porter Designs and you or any other party be deemed to modify any provision of these Terms of Use. These Terms of Use shall not be interpreted or construed to confer any rights or remedies on any third parties.

Porter Designs has created this Privacy Statement in order to demonstrate our commitment to privacy. The following discloses our information gathering and dissemination practices for the Website.

Registration/Ordering/Purchasing

The Website's registration and order forms require Wholesale Customers to give us contact information (like their name, e-mail address and account number). We use customer contact information to send the customer information about our company. The customer's contact information is also used to contact the visitor during business hours for either customer service support or any order-processing questions we may have. The customer will also be contacted to confirm the delivery date or pickup, and time. WARRANTY

Porter Designs appreciates your business. We have taken every effort to ensure our furniture product fulfills your expectation of quality and durability. The following warranty is extended to the original purchaser with original proof of purchase.

Limited Upholstery Warranty:

Frame and Springs: Lifetime Limited Warranty

The frame, upholstered in the original fabric under normal use and conditions, is warranted to the original purchaser against manufacturing defects. The springs, under normal use and conditions, are warranted against breakage due to defective material or workmanship. Lifetime means the normal useful life of the product; customarily seven (7) years. After one (1) year from the date of purchase, the warranty covers replacement parts only, and the original purchaser will be responsible for labor.

Seat Cushions: Limited Warranty

The seat cushions are warranted against loss of roam resiliency for a period of one (1) year from the date of purchase. Please do not confuse loss of foam resiliency with softening. Cushions will soften through normal use and conform to the users shape. This is normal and is not considered a defect.

Fabric/Leather: Limited Warranty

Upholstery fabrics and leather are warranted against defective material or workmanship for a period of one (1) year from the date of purchase under normal use and care. Fabric fading, piling, shrinkage, stretching, wearing quality and color fastness are not covered by this warranty. Fabric damage due to chemical treatments applied by the retailer or consumer, heavy soiling or improper cleaning will void this warranty.

Mechanisms: Limited Warranty

The mechanisms in recliners, sleepers or sofa beds are warranted to be free from defects in materials and workmanship, for a period of one (1) year from the date of purchase. Improper handling, care or abuse of the unit will void the warranty. Sleeper mechanism should not be closed with sheets, bedspreads, blankets or pillows on the mattress as this can cause failure of the sleeper unit and will void the sleeper warranty. Caution: Children should not be allowed to play on or operate motion products. Always leave unoccupied chairs in closed upright position.

This warranty supersedes and replaces all implied warranties of merchantability and for particular purpose. No representative, employee, agent of Porter Designs, or any other person is authorized to assume for Porter Designs any additional liability or responsibility in connection with Porter Designs' merchandise except as described above. In no event shall Porter Designs be liable for indirect, consequential or incidental damages of any kind such as damage to other property owned by the purchaser, or personal injuries sustained by purchaser, loss of profits, loss of use or other economic loss, nor shall its liability exceed the purchase price of the product.

If within the warranty period, identical materials are unavailable at the time of the repair or replacement, Porter Designs reserves the right to substitute materials of equal or better quality. Replacement fabrics may vary in color from the original due to dye lot differences. Porter Designs is not obligated to refund money to the purchaser. Any item repaired or replaced under these warranties will be covered by the warranties for the remainder of the original warranty period only.

WARRANTY IS VOID FOR ANY, BUT NOT LIMITED TO, THE FOLLOWING CONDITIONS:

  • Improper maintenance or use resulting in damage.
  • Any product modifications.
  • Products sold "AS IS", floor samples, in liquidation, or purchased second hand.
  • Warranty does not cover minor variations between floor samples/printed illustrations/web pictures and your product.
  • Use of furniture for any other reason than use in a residential setting.
  • Use of furniture in an industrial, commercial, institutional, contract or rental environment.
  • Dissatisfaction due to buyer's remorse.
  • Normal wear and tear.
  • Damages incurred during transportation.
  • Damages incurred by assembling or maintenance.
  • Damages incurred by accidents or abuse.

PORTER DESIGNS LIMITED CASE GOOD WARRANTY

Porter Designs warrants its residential case goods products to be free from defects in material and workmanship under normal use and service for a period of one (1) year from the date of purchase.

This limited warranty applies exclusively to the benefit of the original purchaser of the product under conditions of normal residential usage only and will terminate in the event of resale or commercial use. Any product modifications by the consumer, or use of non-Porter Designs parts, voids the warranty. All warranty claims must be accompanied by the original dated proof of purchase and contain a brief description of the defect in question.

Porter Designs case goods are made with a variety of natural materials. These include, but are not limited to, various wood and plant species, stones and minerals, and certain animal by-products. Certain changes in these materials over time are expected and are not considered defects and are not covered by the limited warranty. For example:

  1. Organic materials have inherent variations. Wood will have knots, cracks, splits and uneven edges. Stone and marble contain vein-lines, hairline fissures, pores and color variations. These natural characteristics are not considered defects. Because stone and wood are porous, spills allowed to seep in may not be removable. Wipe any spills immediately.
  2. Each piece is truly unique due to the individual attention it receives. This is a result of the varying application techniques that are hand crafted. These variations are not considered a defect.
  3. Natural color changes, variations, or movement in lumber or veneer products, and exposure to extreme temperature changes and/or direct sunlight, may cause color and/or surface changes which are not considered defects.

This warranty supersedes and replaces all implied warranties of merchantability and for particular purpose. No representative, employee, agent of Porter Designs, or any other person is authorized to assume for Porter Designs any additional liability or responsibility in connection with Porter Designs’ merchandise except as described above. In no event shall Porter Designs be liable for indirect, consequential or incidental damages of any kind such as damage to other property owned by the purchaser, personal injuries sustained by the purchaser, lost profits, loss of use or other economic loss, nor shall its liability exceed the purchase price of the product. Porter Designs may examine the product and will decide, at its sole discretion if it is covered under this limited warranty. If within the warranty period, identical materials are unavailable at the time of the repair or replacement, Porter Designs reserves the right to substitute materials of equal or better quality. Replacement pieces may vary from the original due to differences in color, natural grain character or live edges. Porter Designs is not obligated to refund money to the purchaser. Any item repaired or replaced under these warranties will be covered by the warranties for the remainder of the original warranty period only. All repair work must be authorized by Porter Designs in advance.

How To Obtain Service:

To obtain service under this warranty please contact the Porter Designs dealer from whom you purchased your product. Proof of purchase (original bill of sale) is required. Transportation expenses will be the purchaser's responsibility. If the item is considered under warranty, Porter Designs, at their discretion, will have the option of replacing or repairing the item.

 

FURNITURE FACTS

General Care Tips

  • Many items can be maintained regularly by simply wiping with a soft dry cloth to remove dust.
  • To protect your furniture, avoid placing it in direct sunlight or too close to heat sources. Do not place hot items directly onto furniture as they can damage the finish. Use felt pads or other protective layers such as coasters when placing any items on finished surfaces.
  • If spills occur, wipe immediately with a soft damp cloth or spot treat. Make sure to wipe dry after cleaning to avoid water spots.
  • Do not use harsh chemicals or abrasives as they can damage surface areas.

Basic Upholstery Fabric Care Tips

  • For everyday cleaning of your fabric upholstered pieces, use the upholstery attachment on your vacuum cleaner to vacuum the surface of the furniture to remove any loose dirt. It’s also a good idea to vacuum underneath the cushions as well.
  • If you can, flip your cushions regularly to distribute the wear and to reduce soiling.
  • Clean spills immediately by gently blotting with a clean, absorbent cloth. If a stain remains, then you’ll have to do some deeper cleaning according to the fabric’s code.
  • W Code W stands for ‘Water based cleaner’. This code means that you can spot clean your fabric with a water-based shampoo or foam upholstery cleaner. You can use a brush to agitate the cleaner or even an upholstery attachment on a carpet cleaner. Be careful to avoid over-wetting the stain.
  • S Fabrics that are Code S must be cleaned with solvents (dry clean only). You can spot treat stains with a water-free solvent or dry-cleaning product. Use solvent cleaners in a well-ventilated room and keep away from open flames. Avoid using cleaning products containing carbon tetrachloride, as it is highly toxic.
  • W/S A W/S code, as you might expect, means that a combination of dry cleaning solvents and water-based cleaners may be used. These fabrics can be spot cleaned with upholstery shampoo, foam from a mild detergent, or a mild dry cleaning solvent. This is a case where a pre-test is especially important. For overall dirt, call a professional to clean these fabrics.
  • X If you have fabrics with Code X, they can only be cleaned by vacuuming or light brushing. A Code X means the fabric is not cleanable with water or solvent cleaners.
  • Once you’ve determined how to clean your fabric, it’s always a good idea to pre-test the cleaner on a small, inconspicuous spot on the fabric. This way you can make sure the cleaner works and doesn’t leave a spot or cause the colors to bleed. If you’re in doubt about how to proceed, it’s usually best to call a professional upholstery cleaner. 

Leather Care Tips

  • Dust leather with a clean, dry cloth and vacuum it regularly using a soft brush attachment.

No-Sag Springs
"S" shaped wires that are fastened to the front rail and run from the front to the back of the furniture every few inches apart.

8-Way Hand Tied Springs
Each spring is hand tied eight ways (front to back, side to side & diagonally). A sign of quality construction, these coils offer the highest level of comfort and durability.

Webbing
Woven fibers cut in strips and stretched across the furniture frame.

Corner Blocked Frame
Frame is blocked and screwed, providing lasting strength.

Wood Encased Frame
Insures a quality appearance and prevents fabric from stretching.

 

Cushions

Foam
Foam cushions. The higher the density of the foam the better support.

Pocket Coils
Individually wrapped coils maintain their shape and are more resilient and plush than foam cushions.

Down
Made from feathers, down offers maximum comfort. Down may require more maintenance than foam but offers greater durability and resilience.

 

Leather Lingo

Top Grain
Top grain leather is made from the strongest fibers of a leather hide and is the most durable; the hide surface is sanded and refinished.

Full Aniline
A top-grain leather that is dyed with the color permeating all the fibers. No additional coloring is needed.

Semi Aniline
A top-grain leather that is dyed on the surface only and coated with matching pigment for add protection.

 

Split
The bottom layers of the hide that have been split off from the top grain leather, then pigmented or sueded.

Bicast Leather
Polyurethane applied to the surface of split leather and embossed. While slightly stiffer than top grain, it has a consistent texture, is easy to maintain and durable.

Blended Leather
A man-made material composed of 17% leather and other fibers that are bonded together. Extremely durable and an environmentally friendly choice.

 

Bonded Leather
Much like blended leather, bonded leather is man-made. However, rather than intertwining or melting the real leather and synthetic material together, real leather scraps are fixed in a polyurethane mixture.

Bicast Poly
A 100% man-made material that offers the most realistic leather look and feel. Bicast poly provides excellent durability.

Leather-Look

Our stunning India hardwood collection is made from solid Sheesham, Mango and Acacia wood. These species feature beautiful wood grains and are harvested from sustainable plantations.

We carry truly unique pieces which add architectural layers to a worldly, well-traveled home.

Sheesham is an eco-friendly deciduous tree, native to the Indian subcontinent. Sheesham has a beautiful irregular grain structure which is distinctive in appearance. Sustainable sourced through government managed plantations, it is methodically kiln-dried. Our furniture is crafted from both the dark heartwood and the lighter-colored sapwood of the tree which gives the wood grain its beautiful rich contrast.

Mango Wood

Mango is a beautiful, eco-friendly dense hardwood native to SE Asia. Harvested through sustainable, fast-growing tree plantations, old fruitless trees are cut down and new trees are planted to take their place. Durable and as dense as ash or cherry wood, mango wood has a rich color that varies in tone. Our beautiful mango wood timber is kiln dried and treated to ensure its longevity.

Acacia is prized for its durability, moisture resistance and solidity. Acacia trees are fast-growing and survive well in tropical regions. Eco-friendly acacia is a traditional hardwood renowned for its beautiful variegated grain patterns and rich color. This kiln dried wood is hard and very heavy which makes it ideal for withstanding the wear and tear of modern family life.
